SMS Policy for TCPA Compliance

Purpose: This policy outlines the guidelines and procedures for sending SMS messages in compliance with the Telephone Consumer Protection Act (TCPA) regulations to ensure that all communications via SMS are conducted ethically, legally, and with respect for recipients’ privacy and preferences.

Scope: This policy applies to all employees and agents who are involved in sending SMS messages on behalf of Atlanta Office Technologies aka AOT.

Policy:

  1. Permission-Based Messaging:
    • SMS messages will only be sent to recipients who have provided express consent to receive such messages.
    • Consent must be obtained through an explicit opt-in process clearly explaining the purpose and frequency of the messages.
    • Recipients must have the option to easily opt-out of receiving further messages at any time.
  2. Identification:
    • All SMS messages sent on behalf of AOT must clearly identify the sender.
    • The sender’s identity may include the company name, a recognizable brand, or a unique identifier associated with the company.
  3. Content Guidelines:
    • SMS messages must contain accurate and truthful information.
    • Messages should be concise, relevant, and clearly convey the intended purpose.
    • Content must comply with applicable laws and regulations, including but not limited to TCPA, CAN-SPAM Act, and other relevant consumer protection laws.
  4. Frequency and Timing:
    • SMS messages should be sent at reasonable intervals and times, taking into consideration recipients’ preferences and avoiding excessive messaging.
    • Messages should be sent during appropriate hours to avoid inconvenience to recipients.
  5. Data Security:
    • Recipients’ personal information collected for the purpose of sending SMS messages must be securely stored and protected from unauthorized access.
    • Use of recipients’ data must comply with applicable privacy laws and regulations, including GDPR, CCPA, etc.
  6. Record-Keeping:
    • Records of consent, opt-ins, opt-outs, and message content must be maintained in a secure and accessible manner.
    • These records should be retained for a minimum period as required by law or company policy.

Non-Compliance: Non-compliance with this SMS policy may result in disciplinary action, up to and including termination of employment or contract, as well as legal consequences for both the individual and the company.

Review and Updates: This SMS policy will be reviewed periodically to ensure continued compliance with relevant laws and regulations. Updates may be made as necessary to reflect changes in the regulatory landscape or company practices.

Acknowledgement: By sending SMS messages on behalf of AOT, employees and agents acknowledge that they have read, understood, and agree to comply with this SMS policy.
